Kenk to lose thousands of bikes as details of civil settlement reached


  • Igor Kenk will give up his used-bicycle shop, pickup trucks and his hoard of more than 2,200 old bikes in a settlement reached Friday in a civil suit brought against him by the province of Ontario.

    Under the deal, Mr. Kenk will get to keep the proceeds of a provincially-supervised sale of the bike shop, which he has previously valued at $700,000, but only after he pays $50,000 to the Crown, $65,000 to Legal Aid Ontario for his ongoing criminal case, legal fees incurred to defend against the suit, and any outstanding taxes or bills related to the building. The bikes and pickup trucks will be sold off and the proceeds kept by the Crown.

    The settlement brings an end to one of two parallel court proceedings, one civil and the other criminal, brought against the 50-year-old Mr. Kenk, whose arrest in the summer of 2008 and subsequent raids of his numerous rental garages filled with bicycles stunned Toronto's cycling community.

    Friday's settlement was reached before the court tested the government's case, which hinged on affidavits from Toronto police who led the criminal investigation. Court filings showed that officers relied on a confidential source for information about Mr. Kenk's alleged drugs-for-bikes enterprise. Court never heard testimony from the source, nor does the case file contain any written statements from the informant.

    Jacob Stilman, lawyer for Mr. Kenk, said outside court that the government's forfeiture application “was going into uncharted legal waters in the sense of asserting that the building was an instrument of criminal activity.” He suggested “there would have been a lot of interesting legal and evidentiary issues” had the case gone to trial, but also serious implications for his client, who stood to lose virtually everything he owns.

    “While it's fascinating from a lawyer's perspective,” Mr. Stilman said, “the stakes are very high for the person at the receiving end of the litigation.”

    According to court filings, Mr. Kenk paid $85,000 for his shop in 1995 and is mortgage-free. Its value has since skyrocketed due to gentrification along trendy Queen Street West. The bicycles were recently appraised at just over $50,000, and the two Toyota pickup trucks at $14,000.

  • Stolen-bike case close to ending in deal, court told

    Lawyers in the Igor Kenk stolen-bicycles saga are discussing a possible deal to resolve the massive criminal case and head off a trial for the 50-year-old bike repairman, a Toronto court heard yesterday.

    Mr. Kenk, 50, was charged with more than 80 counts involving 2,865 used bicycles and a large quantity of illegal drugs seized in police raids in the summer of 2008, and has been awaiting trial in the Don Jail for almost a year since his bail was revoked last December.

    Mr. Kenk appeared yesterday at the Ontario Superior Court of Justice, where he was to make a bid to have bail restored. Instead, his lawyer, Lon Rose, told Mr. Justice John Hamilton that "a proposed resolution to most if not all" of Mr. Kenk's charges is in the works as a result of pre-trial talks with Crown officials and lower-court Justice Kathleen Caldwell.

    ...

    The sheer size of the case, which involved raids on 12 properties, about 100 police officers and more than 80 charges, created a mountain of evidence to be gathered, sorted, assessed and disclosed to Mr. Kenk's defence before any trial could proceed.

    Court filings obtained by The Globe and Mail, including Mr. Rose's Nov. 12 notice of application for yesterday's bail review, suggest that disclosure has been slow and sporadic. Mr. Rose only recently received, for example, statements from 70 police officers who worked on the case. Dozens more pieces of evidence have also been slow to materialize.

    Regardless of any deal in the offing, Mr. Kenk still faces a lawsuit brought by the Ontario Ministry of the Attorney-General to seize his bike shop, two pickup trucks and 2,292 bicycles as proceeds of crime. Even though Mr. Kenk has not been convicted criminally, the province can use the Civil Remedies Act to seize and sell off his property if it can prove that it was used for a criminal purpose or obtained by crime.

My Trek 750 was stolen in my courtyard - out the front of my door!

It is a men's mountain bike, silver with red and black detailing. It has a 17.5" frame, in good condition.

The front tire won't match the back one - they stole the tire from a bike next to mine. The rear-brake lever is slightly bent from an accident I had a couple of years ago.

Stolen: Blue Giant ATX 840 from John and Richmond

Some jerk took my husband's bike tonight as we were at a movie with our kid. We were at the Scotiabank theater at John and Richmond.

It's old, no seat, no pedals. Shouldn't be worth much to someone else but this bike has sentimental value and was used every day for commuting.

If you have any info please contact.
Reasonable reward if this bike is returned promptly.

Stolen: 2009 blue Devinci Milano hybrid

* General Description: This was a brand new bike - only my 4th time using it. It had a Kryptonite KryptoFlex lock attached to the frame with a bracket, a silver bell, a rear rack with a blue bungie cord and NO kickstand.

* Date of Theft: FRIDAY, AUG 14TH BTW 8PM-10PM

* Location of Theft: 127 PORTLAND ST. BTW RICHMOND & ADELAIDE

Black Norco Bushpilot (Islington & Lakeshore)

Someone ripped the lock off my garage on the night of July 13/14th and made away with my Norco Bushpilot. It's fairly distinct - large mudguards over the front and rear tires, Duke's Cycle sticker in the bottom corner on the down tube of the frame (queen of hearts), street tires rather than mountain. When stolen it also had a cable lock attached to the seatpost, and a bell fitted upside-down next to the shifter on the right side of the handlebar.

See my actual bike first, product shot second in different colors.

BMW - White Cruiser

My white BMW cruiser was stolen from my front porch this morning.

It is a very distinctive bike with BMW insignias on the frame and on the handlebar joint. It had black pannier bags across the back wheel and a brand new LED light on the handlebars.

It was stolen August 11 between 5AM and 10AM from my front porch in the Roncesvalles/Queensway area.

There is a BIG reward for information leading to its safe return.

Brown Vintage Pacer Bike (Bloor & Dundas West)

New Avenir Red Folding Bike (Bloor & Bathurst)

I bought the bike at Bathurst Cycle at 2 pm this afternoon (Sun. July 5, 2009) and it was stolen locked up outside Sushi on Bloor (Bloor east of Bathurst) less than 30 minutes later.

I am suspicious that it was an inside job done by the bike store. Sold me a crappy lock and then someone followed me. When I went back to Bathurst Cycle they were so unsympathetic it made me cry.

I have reported it stolen to the police.

Stolen off the front porch. Left it unlocked for 5ish minutes to run inside the house – came back and it was gone.
Time: sometime around 5:55pm and 6:10pm Saturday July 4th
Place: Bellwoods Ave, halfway between Queen & Dundas
Make: Light grey / dark grey Gary Fischer 'Tarpon'
It was about 5 years old, paint chipped, black gel-style seat with rip, giant black un-cuttable chain lock was still attached to frame & seat post (good luck getting that thing off!!), 2 black fenders, black bell, red Bell helmet was stolen too.

Blue "Set Me Free" Hybrid (Bay & Wellesley)

My bike was stolen from the bike racks in front of the Ministry building at the corner of Bay and Wellesley this Monday, June 22 between 1:30 and 4:30pm. My toddler got up this morning asking for his usual bike ride to "school". I am mad - as I am sure most people feel as victims of bike theft - but the audacity to take a bike with a toddler seat on the back! This was our transportation to daycare and work!

The bike is a "Set Me Free", deep blue, men's hybrid (19), not even one month old. There is a limo co-pilot seat on the back and a silver wire basket on the front.

I will pay to get it back. I just want the same bike, with toddler seat (nice to have the helmet and shoes back too!) returned. Please consider reselling this to me - or alerting me if you see it. I will agree to whatever discretion necessary to pay for its return.

Norco Kokanee - Orange (Bloor/Brunswick)

Stolen from my backyard just north of Brunswick. The bike has horns on the handlebar (the right one is broken in half), slicks for tires, clipless pedals, front and rear fenders, back rack, a thin, hard Italian seat, and the part where the pedals attach to (always forget the name) is a bit loose, and can't be fixed.

My bright orange Peugot bike was stolen from my front yard last night (St.Clair and Glenholme.) My lock was cut...and strangely another bike was left in its place.

The bike has the name and address of my hometown bikeshop riveted to the frame (Macqueen's Bicycles, Charlottetown PEI) along with a serial number.
It has a new "Planet Bike" seat, and a black plastic mud flap on the back.

I don't see many orange Peugot bikes around Toronto, so if you see one let me know.

  • My bike of 7 years was stolen form my apartment building this last weekend.
  • Last seen In the Danforth / Main Area.
  • It is a rare European model released in robins egg/baby Blue and orange with the Manitou Sxr Fork painted to match (Orange with Blue ).
  • Their are a lot of 2000 era Specialized Stumpjumper M2's around but all the ones in North America were released with Black and red colours.
  • The bike itself is in pretty rough shape having been ridden hard for several years and had home maintenance -Blown front fork, creaky headset / crank, loose break levers, crappy SPD pedals.
  • That said it still has full XT componentry with an XTR rear derailer and I bought the bike when I was 16 with my life savings so it has a lot more value to me than anybody else.
  • Please contact me if you see or hear anything about it, the serial number has been registered with the Police and I can recite it if you have found the bike and wish to verify my ownership.

* Model - An old 10-speed frame, unsure of model, but the frame was large (i'm 6'4)
* Colour - Painted matte white - frame has scratches from wear and tear along it
* General Description (especially any unique characteristics) - As said above, its a large frame, and would have been difficult for anyone under 6 foot to ride. Its a fixed gear bike, and the toe clip had just fallen off the right pedal, so one pedal is bare, one has a plastic toeclip on it. The bars are regular drop bars, with no tape, and only one brake handle on the right side of the bars.
* Date of Theft - Tuesday May 26th - 1:15PM
* Location of Theft (intersection or specific address) - Dundas St W & Palmerston Ave

Unfortunatly I don't have a picture of the bike on me right now, but I did see the guy, chased him for a while but it was to no avail.

Description of theif: White male, mid 30's, probably around 6foot - 6'2", 180-190 lbs, knows how to ride a fixed gear pretty fast (evaded two cars chasing him down sidestreets), he wore a hat, a black jacket with reflective stripes and had bolt snips that fit in his bag.

Back-pedal brakes, one gear. Old black seat with small repair on left side. Also, it had a u-lock holder thing on the seat post which was held on with rusty screws and a lot of yellowy epoxy. I bought it from Mrs. Huzinga's on Roncesvalles last June. Only a little rust.

I can offer a small reward. But I can't afford a new bike. Can anyone help?

The weather is getting warmer, so unfortunately, even with the huge Igor Kenk bust last year, we're going to see more bike stealing on the streets of Toronto.

BikingToronto has dedicated an entire section of the Forum to Stolen Bikes - with one thread reserved exclusively for listing stolen bikes, in the hopes that visitors may recognize one on the street and help re-unite the bike with the owner.

For some good news to end of this post, I'll leave you with the story of Darryl the Chopper Bike... a Stolen Bike story with a happy ending!

My bike is RIGHT here, back at home. Am never leaving it where I cant see it again!

How did I get my bike back?? As soon as my bike went missing I posted Craigslist and emailed EVERYONE, who posted it EVERYWHERE, (THANK YOU ALL SO MUCH) because who would be dumb enough to steal a zebra covered art chopper bike???

There are a lot more details Im leaving out, sleuthing, photos, asking all the neighbors, calling 14th div, for advice, but long story short, with the help of some good friends he's back.

I then got an anonymous email from my LOST AND FOUND posting on Craigslist, telling me vaguely where my bike was. Then I got another, with more information- that it was in a bar, and was used against a bar tab!!

Apparently the idiot who stole it took it for a joyride then to a bar and left it as collateral. He tried to rip off the fur and the stickers and couldn't, or maybe he realized it was too original, so he ditched it. Lucky for me!!!

When I called the bar this morning as soon as it opened the kind lady there knew right away what I was talking about. I raced down (I have never run so fast) to a sketchy bar on Bloor street and there he was. Darryl!!! I gave her flowers as a thank you and everyone told me how much they loved my bike and how they wondered who owned it. They were so kind.

Later when I thought about it, the reason they still had it and were trolling on Craigslist is that they probably thought that they could sell it, but seeing it all over the net (thank you all!), they probably realized that this bike was not only hot, it was HOTTT! I didn't even think to ask them about the thief.

Crying with joy, I inspected him quickly and rode Darryl home like a bat out of hell. His fur was torn a bit and they had tried to remove the stickers, but hes really no worse for wear.

THANK YOU EVERYBODY. Thank you stranger who emailed me, whatever your intentions. Thank you universe!!! Darryl's home.

Now we just have to find the bike thief and nail him!!

Blue Leader Bike (College and Spadina)

(Stolen September 6, 2008)
-Leader
-Adventure
-Blue with yellow lettering of the word "Leader"
-A blue mountain bike with fenders. (If I remember correctly the wheel size was 26 inch.)
-It has 15 speeds, with the word "Leader" and "Adventure" on the frame in yellow letters. It has a black bottle holder that is quite flimsy, and had a blue U of T "Skule" stick on the frame(though it can be easily removed). Also had a bell mounted on the right side of the handle bars.
Stolen on September 6, 2008 around 7pm, one block east of College and Spadina (Toronto, Ontario)

Would really love to get it back as it's my first bike and is quite sentimental.
If anyone was in that area, has any information, or has found my bike, please contact me, thanks!

I had the bike leaned up against a wall and was helping a friend load some stuff into his truck. The bike was not more than ten feet behind me. When I had my back turned, some scumbag must have siezed the "opportunity" and grabbed my baby.

Just goes to show, you can't be too carefull. This guy must have been watching me, because he only had a few seconds to grab it while my back was turned - In broad daylight, within ten feet of the owner and another guy, both of whom would have whipped his ass if we caught him.

I don't really expect to get it back, but now that Igor is gone, where do you go to look for your bike once it gets stolen? I'm thinking the queen st. pawn shops, anyone else have ideas?

Supercycle Hooligan MTB (Yonge & Adelaide)

Lost my Supercycle Hooligan 21-speed Dual-suspension mountain bike to a dirty thief during Nuit Blanche Oct 4, 2008 around 4am @ Younge and Adelaide. The bike was chained to a railing; it is missing the seat (I still have it), the back brake cable is a bit loose, everything else was in great condition. I don't expect to ever see my bike again, but I sincerely hope the thief overdoses on crack purchased with my bike's money.

The Igor Kenk Saga (which made international headlines) seemed to somewhat alleviate the frustration of Toronto cyclists in having their bicycles stolen only to find them show up in Igor Kenk's store a few days later.

However, now Toronto cyclists get the frustration of the delays of the legal system as Kenk's trial has been delayed for 6 weeks so his lawyer can look at over 4,000 new pages of evidence:

In a brief court appearance this morning at Old City Hall, the accused bike thief was awarded a six-week adjournment so his attorney, Lon Rose, can review the thousands of documents involved in his case.

He also plans to ask for another one once that one has been completed, Rose said.

"I've been told there are over 4,000 pages," none of which have currently been provided to the defense, Rose told the court.

The Crown expressed "concerns" about the six-week delay, fearing the case would lose momentum. [Toronto Star]

Green Iron Horse Team FS (Pape and Danforth)


I just lost my 2006 Iron Horse Team FS. It was while I was at the gym today between 11:50 and 1:00PM today (Tuesday, September 23rd 2008.) The location was the Extreme Fitness Gym, at the intersection of Pape and Danforth Ave. The bike was locked with a thick cable lock right alongside the gym. It is a green-coloured 21" (inch) frame. Dual suspension and with front and rear mechanical disc brakes. It's Filzer bike computer bracket is still on the handle bar, I still have the computer itself in my pocket. Has detatchable mud guard for rear tire and an overhanging, small Specialized cargo pouch secured by straps beneath the seat. Any help would be appreciated. It was a good, reliable workhorse. Here is a pic of it without the small cargo bag on the seat, from a year or so ago.

Black KHS Urban X (Queen and Parliament)

My son's bike was stolen this afternoon (September 22) from our backyard (Queen & Parliament area) while we were out. It is a black, medium-sized KHS Urban X (commuter-style) with a black carrier rack. It was locked to our iron picnic table with a cable lock and the back wheel was locked to the frame with a Kryptonite U-lock. The theft has been reported to the police. Any news/sightings would be appreciated.

Silver and Black KHS Brentwood (College and Spadina)

I got my bike stolen last night (between Saturday SEP 20 and Sunday SEP 21 2008) on College Street, right in front of this nightclub called Suba (292 College st). I got there around 11 PM and I noticed the theft at about 1 AM. I hadn't locked it properly so they took the frame and the backwheel, and left the front wheel attached to the lock. The bike is a silver and black KHS Brentwood Mens 2007, 17" frame, Shimano breaks and 21 speeds. The original seat had previously been stolen so I replaced it some months ago with one of these black GEL seats. It has a black round bell on the left handle. The serial number is 461066235. I don't have a picture of it but this is the what the model looks like. The color is silver and black though

Make: Trek Model: Not sure, I got it used, but it is a pre-2000 mountain bike frame with wide wheels. Colour: Red. Covered with lots of stickers for punk rock bands. General description: Smallish frame with some wear and tear. Water bottle holder attached. Straight handlebars. Black grips with orange flames. Gear casing on right handlebar replaced with clear plastic, other side black. Black seat also with some wear and tear. Bell on right side. Quick release wheels. No fenders. Date/place stolen: Monday August 25 in the middle of the night from my front porch on Brunswick Ave. (College/Spadina). Wheels were locked together with a Kryptonite U-lock and cable. I miss my baby.

It's been all over the Toronto news, but now the Igor Kenk Stolen Bicycle Saga is going international.

The New York Times published a feature story titled "In a Cyclist-Friendly City, A Black Hole for Bikes" in their World section yesterday:

The arrest has provoked an outpouring of anger and publicity in a city renowned as one of the most bicycle-friendly places in the world. About 15,000 hopeful cyclists, some teary-eyed, have scoured the Kenk collection in search of their missing bicycles. But only 469 bicycles had been returned as of Thursday morning, when 17 more days of public viewings began.

The public reaction “was staggering,” said Ruth White, the superintendent of 14 Division, the police unit that made the arrest. “I’ve never seen anything like it in 30 years.”

Oddly enough, the police and many bicyclists were aware that Mr. Kenk’s little shop, the Bicycle Clinic, appeared to be a black hole that consumed stolen bicycles. Bike theft victims regularly discovered their missing bicycles there, and were often able to recover them, either through vigorous argument or a payment of $30 or $40.


The story has since been picked up by the Houston Chronicle ('Most Hated Man in Toronto' Charged in Bike-Theft Caper) and the International Herald Tribune (Toronto's Mysterious Bicycle Theif).

The Toronto Police have just announced more viewing times for the close to 3000 bikes they found after they apprehended Igor Kenk paying a theif to steal a bike.

The bicycles will be on display at 35 Strachan Ave. (between Lake Shore Blvd. and King St. W.) at these times:

- Thursday, August 21 and Friday, August 22, noon - 8 p.m.,

- Saturday, August 23 and Sunday, August 24, 10 a.m.- 6 p.m.,

- Monday, August 25 to Friday, August 29, noon - 8 p.m.,

- Saturday, August 30 and Sunday, August 31, 10 a.m. - 6 p.m.,

- Monday, September 1, closed

- Tuesday, September 2 to Friday, September 5, noon - 8 p.m.,

- Saturday, September 6 and Sunday September 7, 10 a.m. - 6 p.m.


Owners need proof of ownership, such as receipts or store registrations or pictures with their bicycles as well as photo ID.

Supt. Ruth White, unit commander of 14 Division, urged bicycle owners to combat theft by registering their bicycles online.

Giant Cypress (Victoria Park and Danforth) from craigslist: I had my Giant Cypress stolen in January from the Victoria Park subway station. When stolen it had an electric hub on the front wheel. The hub may have been removed, in which case one of the handlebar pads will be missing too because that is where the speed controller was. I can't make it over to TPS to see if Igor had my bike, but I'm hoping someone else can. I will pay up to $200 for the recovery of the complete bike. I have a record of the serial number that I will provide to TPS.

The latest reports have the numbers exceeding 3000 bicycles, and Toronto Police have set them up in two locations so Torontonians can check them out and hopefully find their long lost two-wheeled friends:

Good news from the streets this morning. Toronto Police set up a "bait bike" operation and two undercover officers watched Igor Kenk, the owner of the The Bicycle Clinic (notorious for selling stolen bikes) as he directed a thief with boltcutters to steal two bikes and then paid him:

Igor Kenk, 49, owner of the Bicycle Clinic at Queen St. W. and Strachan Ave., was put in handcuffs just after 7 p.m. by Consts. James Rowe and Craig Meredith, who were watching the corner as part of a "bait-bike" sting.

Both Kenk and Jean Laveau are charged with one count of theft under $5,000, one count of attempted theft under $5,000, and one count of possession of property obtained by crime.

Coincidentally, officers Rowe and Meredith were part of a three-man team who yesterday planted a so-called bait bike at various high-theft locations downtown.

They had planted an unlocked bike at Queen St. W. and Strachan Ave. around 7 p.m. and were watching the corner when their attention was diverted away from the unlocked bait bike to the locked bike which was allegedly stolen.

Bike Theft in Toronto has been in the news recently, which most of the major news outlets picking up on the fact that a ton of bikes are stolen in Toronto... with theft numbers totalling about 50,000 over the past 10 years, and 5,000 reported stolen in 2007.

Note that these numbers are reported thefts. A lot of people don't bother registering their bikes with the police and just shrug their shoulders and eventually get another cheap bike.

A reminder that if your bike has been stolen recently, you can let a lot of other people know through the Stolen Bike Listing on the BikingToronto Community. Also be sure to report the theft to the police as well!

I got my bike stolen today, and I am devastated. It's been my solace from all the other bullshit that I've had to go through in the last few months. The make/model is a Raleigh Chill Dual Suspension - which I bought in Calgary 5 years ago. It is blue and black with no seat (because I have it). The date is June 30th, 2008. My heart sank when I walked out of the library yesterday, to find that my bickle, who had taken me all over the world, was gone. I have never experienced such intense feelings of rage and powerlessness in my life. My purple Schwinn SOTO Mountain Bike stolen last night (June 12th) at Bloor and Ossington, outside of CIBC. Shimano brakes, basket on the front, bell on the handlebars.

26" tires, 16" frame. I use a kryptonite lock, and am careful about locking it - usually use two locks but not last night for some reason!

I know am am not unique... but my beloved bike was stolen recently from the bike rack on the side of my building (Broadview near Mortimer). It's candy-apple red and gold in colour. The make is 'Giant'. It had a worn out grey suspension seat, and I really loved it. If anyone comes across it, please bring good karma to yourself and get it back to me!

  • Please note that my bicycle was stolen on Friday b/w 9:45 am 5:10pm from the corner or Bay and Elm Street.
  • Date Stolen:Friday, May 02, 2008
  • IMPORTANT: At the police station there was another student whose bike also got stolen from College and Bay on the same day. This is the most active area for stolen bikes and other crimes as per the city police map at 55 Division. Both bikes were stolen had a cable lock and some sort of sharp cutter was used. At that spot, all bikes with Hardened steel U-shaped lock were not touched. Police is aware of stolen bike activity but only advised me to buy a good lock next time and they cannot do much as they are busy fighting other crimes, so we bikers are at our own.
  • I just bought this bike on April 20th 2008.

  • Stolen From: 655 Bay Street, Intersection of Bay Street and Elm Street. Bike was locked in the city's installed Bike Stands

When: Evening of May 2 pm to May 3 am

Where: College and Clinton Streets - six blocks west of Bathurst. Next to
front door of residence in the front yard.

How: Kryptonite cable cut with bolt cutter
Please keep your eyes open for this bike on the street and in bike
shops like Uncle Jacobs on Spadina south of College and at Igor's bike
shop on Queen west across from Trinity Bellwoods Park.
