Kenk to lose thousands of bikes as details of civil settlement reached

Igor Kenk will give up his used-bicycle shop, pickup trucks and his hoard of more than 2,200 old bikes in a settlement reached Friday in a civil suit brought against him by the province of Ontario.
Under the deal, Mr. Kenk will get to keep the proceeds of a provincially-supervised sale of the bike shop, which he has previously valued at $700,000, but only after he pays $50,000 to the Crown, $65,000 to Legal Aid Ontario for his ongoing criminal case, legal fees incurred to defend against the suit, and any outstanding taxes or bills related to the building. The bikes and pickup trucks will be sold off and the proceeds kept by the Crown.
The settlement brings an end to one of two parallel court proceedings, one civil and the other criminal, brought against the 50-year-old Mr. Kenk, whose arrest in the summer of 2008 and subsequent raids of his numerous rental garages filled with bicycles stunned Toronto's cycling community.

Friday's settlement was reached before the court tested the government's case, which hinged on affidavits from Toronto police who led the criminal investigation. Court filings showed that officers relied on a confidential source for information about Mr. Kenk's alleged drugs-for-bikes enterprise. Court never heard testimony from the source, nor does the case file contain any written statements from the informant.
Jacob Stilman, lawyer for Mr. Kenk, said outside court that the government's forfeiture application “was going into uncharted legal waters in the sense of asserting that the building was an instrument of criminal activity.” He suggested “there would have been a lot of interesting legal and evidentiary issues” had the case gone to trial, but also serious implications for his client, who stood to lose virtually everything he owns.
“While it's fascinating from a lawyer's perspective,” Mr. Stilman said, “the stakes are very high for the person at the receiving end of the litigation.”
According to court filings, Mr. Kenk paid $85,000 for his shop in 1995 and is mortgage-free. Its value has since skyrocketed due to gentrification along trendy Queen Street West. The bicycles were recently appraised at just over $50,000, and the two Toyota pickup trucks at $14,000.

Stolen-bike case close to ending in deal, court toldLawyers in the Igor Kenk stolen-bicycles saga are discussing a possible deal to resolve the massive criminal case and head off a trial for the 50-year-old bike repairman, a Toronto court heard yesterday.
Mr. Kenk, 50, was charged with more than 80 counts involving 2,865 used bicycles and a large quantity of illegal drugs seized in police raids in the summer of 2008, and has been awaiting trial in the Don Jail for almost a year since his bail was revoked last December.
Mr. Kenk appeared yesterday at the Ontario Superior Court of Justice, where he was to make a bid to have bail restored. Instead, his lawyer, Lon Rose, told Mr. Justice John Hamilton that "a proposed resolution to most if not all" of Mr. Kenk's charges is in the works as a result of pre-trial talks with Crown officials and lower-court Justice Kathleen Caldwell.

The sheer size of the case, which involved raids on 12 properties, about 100 police officers and more than 80 charges, created a mountain of evidence to be gathered, sorted, assessed and disclosed to Mr. Kenk's defence before any trial could proceed.
Court filings obtained by The Globe and Mail, including Mr. Rose's Nov. 12 notice of application for yesterday's bail review, suggest that disclosure has been slow and sporadic. Mr. Rose only recently received, for example, statements from 70 police officers who worked on the case. Dozens more pieces of evidence have also been slow to materialize.

Regardless of any deal in the offing, Mr. Kenk still faces a lawsuit brought by the Ontario Ministry of the Attorney-General to seize his bike shop, two pickup trucks and 2,292 bicycles as proceeds of crime. Even though Mr. Kenk has not been convicted criminally, the province can use the Civil Remedies Act to seize and sell off his property if it can prove that it was used for a criminal purpose or obtained by crime.

It has a 17.5" frame, in good condition. The front tire won't match the back one - they stole the tire from a bike next to mine. The rear-brake lever is slightly bent from an accident I had a couple of years ago. if anyone sees a bike matching this description, please respond or call me at 416-856-0072. Thanks! |

A year after Igor Kenk’s notorious West Queen West bicycle repair shop was raided, there is no sign of a trial for the alleged bike thief, suggesting difficulties faced by the Crown in a case with substantial amounts of evidence to process.
It’s been a year since The Bicycle Clinic was targeted in a police sting that uncovered 2,865 bikes in garages and warehouses throughout the city. The eccentric 49-year-old repair man, a former police officer from Slovenia, was hit with 58 charges relating to bike theft and 22 charges relating to drugs. About $70,000 worth of marijuana and cocaine was allegedly found in the rented Yorkville house Mr. Kenk shared with classical pianist Jeanie Chung, who also faces drug charges.

| Black Norco Bushpilot (Islington & Lakeshore) Posted: 23 Jul 2009 09:15 AM PDT Someone ripped the lock off my garage on the night of July 13/14th and made away with my Norco Bushpilot. It's fairly distinct - large mudguards over the front and rear tires, Duke's Cycle sticker in the bottom corner on the down tube of the frame (queen of hearts), street tires rather than mountain. When stolen it also had a cable lock attached to the seatpost, and a bell fitted upside-down next to the shifter on the right side of the handlebar. See my actual bike first, product shot second in different colors.

The thick cable was cut in a matter of minutes. I know this is wishful thinking but if anyone sees it up for sale or around the area please let me know. Distinguishing features, front pegs removed, red valve cap on front tire, blue star on frame and is in average condition. My white BMW cruiser was stolen from my front porch this morning. It is a very distinctive bike with BMW insignias on the frame and on the handlebar joint. It had black pannier bags across the back wheel and a brand new LED light on the handlebars. It was stolen August 11 between 5AM and 10AM from my front porch in the Roncesvalles/Queensway area. My lock was cut...and strangely another bike was left in its place. The bike has the name and address of my hometown bikeshop riveted to the frame (Macqueen's Bicycles, Charlottetown PEI) along with a serial number.

Its a fixed gear bike, and the toe clip had just fallen off the right pedal, so one pedal is bare, one has a plastic toeclip on it. How did I get my bike back?? As soon as my bike went missing I posted Craigslist and emailed EVERYONE, who posted it EVERYWHERE, (THANK YOU ALL SO MUCH) because who would be dumb enough to steal a zebra covered art chopper bike???
There are a lot more details Im leaving out, sleuthing, photos, asking all the neighbors, calling 14th div, for advice, but long story short, with the help of some good friends he's back.
I then got an anonymous email from my LOST AND FOUND posting on Craigslist, telling me vaguely where my bike was. Then I got another, with more information- that it was in a bar, and was used against a bar tab!!
Apparently the idiot who stole it took it for a joyride then to a bar and left it as collateral. He tried to rip off the fur and the stickers and couldn't, or maybe he realized it was too original, so he ditched it. Lucky for me!!!
When I called the bar this morning as soon as it opened the kind lady there knew right away what I was talking about. I raced down (I have never run so fast) to a sketchy bar on Bloor street and there he was. Darryl!!! I gave her flowers as a thank you and everyone told me how much they loved my bike and how they wondered who owned it. They were so kind.
Later when I thought about it, the reason they still had it and were trolling on Craigslist is that they probably thought that they could sell it, but seeing it all over the net (thank you all!), they probably realized that this bike was not only hot, it was HOTTT! I didn't even think to ask them about the thief.
Crying with joy, I inspected him quickly and rode Darryl home like a bat out of hell. His fur was torn a bit and they had tried to remove the stickers, but hes really no worse for wear.

Blue Leader Bike (College and Spadina) (Stolen September 6, 2008) -Leader -Adventure -Blue with yellow lettering of the word "Leader" -A blue mountain bike with fenders. (If I remember correctly the wheel size was 26 inch.) -It has 15 speeds, with the word "Leader" and "Adventure" on the frame in yellow letters. It has a black bottle holder that is quite flimsy, and had a blue U of T "Skule" stick on the frame(though it can be easily removed). Also had a bell mounted on the right side of the handle bars. Stolen on September 6, 2008 around 7pm, one block east of College and Spadina (Toronto, Ontario) Would really love to get it back as it's my first bike and is quite sentimental. If anyone was in that area, has any information, or has found my bike, please contact me, thanks! Attached are 2 photos, one was taken long ago before I had fenders installed, the other has fenders that I had installed later on. |

| Red 2006 Schwinn (Queens Quay & York) 2006 Schwinn RD700 Roadbike Candy apple red frame Red bar tape Shimano Sora components Bike rack on back New tires Mitchell black tread with silver sidewalls Shimano clipless pedals I had the bike leaned up against a wall and was helping a friend load some stuff into his truck. The bike was not more than ten feet behind me. When I had my back turned, some scumbag must have siezed the "opportunity" and grabbed my baby. Just goes to show, you can't be too carefull. This guy must have been watching me, because he only had a few seconds to grab it while my back was turned - In broad daylight, within ten feet of the owner and another guy, both of whom would have whipped his ass if we caught him. I don't really expect to get it back, but now that Igor is gone, where do you go to look for your bike once it gets stolen? | Green Specialized Crossroads (Harbord & Clinton) This bike was stolen on Harbord Street on Saturday October 18th or Sunday October 19th. The bike was left unlocked and maybe someone thought it was available to take but it was not, I just forgot it there when unloading groceries. | Supercycle Hooligan MTB (Yonge & Adelaide) Lost my Supercycle Hooligan 21-speed Dual-suspension mountain bike to a dirty thief during Nuit Blanche Oct 4, 2008 around 4am @ Younge and Adelaide. The bike was chained to a railing; it is missing the seat (I still have it), the back brake cable is a bit loose, everything else was in great condition. I don't expect to ever see my bike again, but I sincerely hope the thief overdoses on crack purchased with my bike's money. |

However, now Toronto cyclists get the frustration of the delays of the legal system as Kenk's trial has been delayed for 6 weeks so his lawyer can look at over 4,000 new pages of evidence:

![]() The Toronto Police have just announced more viewing times for the close to 3000 bikes they found after they apprehended Igor Kenk paying a theif to steal a bike. The bicycles will be on display at 35 Strachan Ave. (between Lake Shore Blvd. and King St. W.) at these times:
Owners need proof of ownership, such as receipts or store registrations or pictures with their bicycles as well as photo ID. Supt. Good news from the streets this morning. Toronto Police set up a "bait bike" operation and two undercover officers watched Igor Kenk, the owner of the The Bicycle Clinic (notorious for selling stolen bikes) as he directed a thief with boltcutters to steal two bikes and then paid him:

![]() Bike Theft in Toronto has been in the news recently, which most of the major news outlets picking up on the fact that a ton of bikes are stolen in Toronto... with theft numbers totalling about 50,000 over the past 10 years, and 5,000 reported stolen in 2007. Note that these numbers are reported thefts. A lot of people don't bother registering their bikes with the police and just shrug their shoulders and eventually get another cheap bike. A reminder that if your bike has been stolen recently, you can let a lot of other people know through the Stolen Bike Listing on the BikingToronto Community. Also be sure to report the theft to the police as well! News Links:
